Authority in The Management and Utilization of Agrarian Resources in Indonesia

This study examines the construction and institutional distribution of authority in the management and utilization of agrarian resources in Indonesia, particularly where land administration, forestry governance, the Right of Management (Hak Pengelolaan), and ulayat rights intersect within the same space. It tests the proposition that institutional fragmentation should be addressed by concentrating authority in a single institution. Using normative legal research with a statutory approach and systematic interpretation, the analysis maps forms of authority according to their legal source, holder, object, scope of action, legal consequences, and limits, while employing the concepts of attribution, delegation, mandate, the State’s Right of Control, and property–authority as analytical tools. The findings show that the State’s Right of Control constitutes public authority whose exercise is distributed among governmental institutions on distinct normative bases. Land and forestry authorities may operate within the same space without necessarily producing an overlap of competence. The Right of Management is a specific legal instrument for land management and cannot be treated as the general source or prerequisite of sectoral authority independently conferred by legislation. Ulayat rights likewise cannot be reduced either to a delegation of the State’s Right of Control or to the outcome of administrative recognition and land registration, because their existence must be distinguished from the administrative mechanisms through which Ulayat Land is formalized and afforded legal certainty. On this basis, the study proposes a model of differentiated but coordinated authority, under which institutional competences remain distinct while coordination, data integration, cross-verification, and disputeresolution mechanisms operate at points of intersection between legal regimes. Institutional coherence is better achieved through clear delimitation of competence and effective coordination than through centralization of agrarian authority.References
