EFEKTIFITAS PENEGAKAN HUKUM TERHADAP PERATURAN DAERAH PENYELENGGARAAN KETERTIBAN, KEBERSIHAN DAN KEINDAHAN (K3) KOTA BANDUNG DALAM ASPEK KETERTIBAN

Abstract

Street vendors in Bandung has reached 11,000 with no decline in growth according to the survey conduct by UniversitasPendidikan Indonesia (UPI) in collaboration with Badan Perencanaan dan Pembangunan Daerah (Bappeda) Bandung. Street vendor is one of the main contributor to the dirti- ness and traffic in Bandung. Bandung has passed a Regional Regulation Number 3 and 5 about Cleanliness, Order and Beauty to resolve, to prevent and to bulid the street vendors However, lack of legal awareness and law enforcement may constrain the effectiveness of the regulation. Those regula- tion particularly Regional Regulation Number 4 year 2011 about Street put high fine sanction not only for the seller but also for the buyer to prevent them for violating those regulation. To analyse the the compliance level of society and the effectiveness of fine saction for the violation of regulations, this research used used juridical normative approach and comparative method by comparing Bandung’s regulation with other regional regulations related to street vendors at other cities in Indonesia such as Surakarta and Surabaya. This research found that the law enforcement to the violator of street ven- dors regulation in Bandung region is not maximal due to lack of awareness and to obey the law. The criminal sanction such as fine and forced fees are not able to prevent the violation of street vendors regulations.
